A limited liability company, which operates a retirement home consisting of a nursing home and seven apartments in assisted living, complained to the Lower Tax Court in Münster. These apartments are located in the nursing home building. The plaintiff concluded care contracts with the residents of the assisted living facility, which included various services of (extended) basic care and optional services including an emergency call system.
