No deduction of input tax without substantiation with sound invoices

  • The Zeeland-West-Brabant District Court upheld the tax inspector’s decision to disallow input tax deductions for X BV because the company failed to prove that the claimed input tax related to economic services provided to it.
  • The inspector initially identified issues with unsubstantiated invoices and a lack of clarity regarding whether certain expenses were business-related or private, leading to additional assessments.
  • Despite being given opportunities to provide further evidence, X BV did not sufficiently specify which invoice amounts corresponded to services rendered to the company, thus failing to meet its burden of proof.
