Romania Proposes Registration Procedure for Exporters of Energy Products

Romania has taken a further step toward implementing new compliance obligations for exporters of energy products. The President of the Romanian Customs Authority has issued a draft order setting out the registration procedure for exporters of energy products, following the legislative changes introduced by Government Emergency Ordinance (GEO) No. 89/2025. Background: New Registration Requirement under GEO No. 89/2025

GEO No. 89/2025 introduced a new obligation for companies exporting energy products from Romania to hold a registered exporter of energy products certificate. Scope of the Draft Registration Procedure

The draft order regulates the entire lifecycle of the registration certificate, including:

  • the submission and assessment of registration requests;
  • the approval or rejection of applications;
  • the issuance of the registered exporter certificate; and

Approval and Rejection of Registration Requests

Under the draft procedure, exporters must submit a formal registration request to the competent regional customs authority. As a general rule, the application is handled by the regional customs directorate where the applicant has its registered office, while large taxpayers fall under the competence of the Bucharest Regional Customs Directorate. The customs authority assesses the application and issues a decision either approving or rejecting the request. Where a request is rejected, the decision must be communicated to the applicant together with the reasons for refusal, in line with general administrative law principles. [bing.com]

Cancellation of the Registration Certificate

Cancellation may occur where the exporter no longer meets the statutory conditions, fails to comply with applicable fiscal or customs obligations, or breaches the rules governing the export of energy products.
