Summary
-
The Polish government has approved a draft amendment that would apply the standard 23% VAT rate to specified non-alcoholic beverages containing at least 20% fruit, vegetable or mixed fruit-and-vegetable juice. The measure targets principally non-alcoholic alternatives to alcoholic drinks and beverages containing caffeine or taurine.
-
Products within scope are currently generally taxed at 5% when sold as goods and at 8% when supplied through catering services. Under the approved proposal, both forms of supply would become subject to 23% VAT, creating pricing, product-classification and systems implications for manufacturers, distributors, retailers and food-service operators. -
Businesses should not assume that all juice-containing soft drinks are affected. The revised draft uses specific product characteristics relating to juice content, alcohol, caffeine and taurine. Companies should monitor the final legislation and map individual stock-keeping units against the enacted wording before changing tax codes or customer pricing. The Polish government has adopted draft amendments to the VAT Act that would remove the reduced VAT treatment currently available for certain non-alcoholic beverages. The proposal is part of project UD327 and remains draft legislation pending completion of the parliamentary process and publication of the final act.
Under the existing framework, certain beverages classified under CN 2202 qualify for the 5% rate where fruit, vegetable or mixed fruit-and-vegetable juice represents at least 20% by weight of the raw-material composition. When comparable beverages are supplied as part of catering services, they may currently be taxed at 8%. Poland’s standard VAT rate is 23%. [gov.pl], [podatki.gov.pl]
Following changes made during consultation, the draft is more targeted than some earlier descriptions of the measure suggest. The proposed 23% treatment is intended to cover juice-containing non-alcoholic beverages that fall within specified categories, including non-alcoholic beer and other beverages with more than 0.0% alcohol, 0.0% non-alcoholic beer, and beverages with added caffeine or taurine. The government withdrew an earlier proposal to increase VAT on grape must. [legislacja…rcl.gov.pl], [legislacja…rcl.gov.pl]
The change would replace the current 5% rate for retail supplies and the 8% rate applicable in catering with the 23% standard rate for products within scope. The government’s stated policy rationale is that preferential VAT treatment is not justified for products that imitate alcoholic beverages or for energy drinks, particularly in view of public-health and youth-protection considerations. [gov.pl], [legislacja…rcl.gov.pl]
The practical impact extends beyond updating a VAT percentage. Beverage producers and distributors will need to confirm the CN classification, composition and alcohol, caffeine or taurine characteristics of each product. Retailers and catering operators may need coordinated changes across article masters, point-of-sale systems, price labels, promotions and contracts. Particular attention should be paid to mixed products, private-label ranges, transitional stocks, returns, rebates and supplies spanning the effective date.
Businesses should also distinguish this VAT proposal from the separate reform of Poland’s sugar levy. Although both measures affect beverage portfolios and may increase consumer prices, they have different taxable events, calculation rules and compliance processes. Until the legislation is enacted, implementation teams should maintain the proposal’s status as “draft approved by government” rather than presenting the 23% rate as already effective.
