Cross-border rental does not automatically constitute an excise acquisition of a passenger car

Summary

  • In an individual interpretation dated 3 August 2026, the Director of the National Tax Information Office accepted that a Polish company renting passenger cars from a German supplier and bringing them into Poland was not liable for excise duty on an intra-Community acquisition merely because it physically moved and used the vehicles in Poland. [sip.lex.pl], [qmap.pl]
  • The interpretation followed judgments of the Provincial Administrative Court in Wrocław and the Supreme Administrative Court. The courts treated the absence of ownership-like disposal rights as decisive: a tenant required to return the vehicles did not acquire the right to dispose of them as owner for the relevant excise provision. [sip.lex.pl]
  • The conclusion is fact-specific and should not be treated as a blanket exemption for all foreign-rented vehicles. Businesses should examine contractual control, vehicle registration, duration and place of use, return obligations and other potential excise-triggering events. An individual interpretation formally protects the applicant in the circumstances described, rather than all taxpayers. [edgp.gazetaprawna.pl], [sip.lex.pl]

Article

The Director of the National Tax Information Office has issued a favourable interpretation concerning passenger cars rented from another EU Member State and brought into Poland. Interpretation 0111-KDIB3-3.4013.272.2018.10.MW, dated 3 August 2026, concluded that the applicant was not required to pay Polish excise duty on an intra-Community acquisition in the circumstances described. [sip.lex.pl], [qmap.pl]

The applicant was a Polish company renting passenger cars on a long-term basis from a counterparty established in Germany. The vehicles were registered and authorised for road use in Germany. The company collected them there and moved them to Poland for use, but it did not own them and did not register them in Poland. At the end of the rental period, the cars were to be returned to the German owner. [sip.lex.pl]

The interpretation was issued following earlier litigation. In reassessing the application, the tax authority took account of the judgment of the Provincial Administrative Court in Wrocław of 26 October 2023, case I SA/Wr 592/23, and the judgment of the Supreme Administrative Court of 24 February 2026, case I FSK 466/24. The authority then accepted the company’s position concerning the absence of excise duty on the rental and movement of the cars into Poland. [edgp.gazetaprawna.pl], [sip.lex.pl]

The key distinction is between the physical movement of a vehicle and an intra-Community acquisition for Polish excise purposes. On the reported analysis, an ordinary tenant that must use the car in accordance with the agreement and return it to its owner does not obtain the right to dispose of the vehicle as owner. Physical possession and operational use therefore did not, by themselves, satisfy the acquisition condition addressed in the case. [sip.lex.pl], [qmap.pl]

The development is commercially relevant for groups using vehicle fleets supplied under cross-border rental arrangements. Nevertheless, the conclusion is narrower than a general statement that rented foreign cars are never subject to Polish excise. Different contractual rights or conduct could alter the analysis. Separate excise rules may also require consideration if a vehicle is registered in Poland, sold, permanently transferred, or otherwise becomes subject to a distinct taxable event.

Businesses should document the foreign registration, ownership, rental conditions and mandatory return of each vehicle. Agreements should clearly limit the lessee’s disposal rights and avoid language suggesting an ownership transfer or purchase commitment unless that is commercially intended. Fleet and tax teams should also monitor where vehicles are principally used and whether later changes to the contract, registration or ownership create a new assessment point.

Finally, the interpretation is an individual ruling issued after court proceedings. It is persuasive for comparable arrangements but formally provides protection to the applicant on the stated facts. Taxpayers with material fleets or materially different contractual terms should consider obtaining their own Polish analysis or individual interpretation.
