Portugal Issues New Guidance on VAT for Construction Services and Residential Property
- The Portuguese tax authorities issued Circular Letter No. 25117/2026 (24 June 2026) on the reverse charge for construction services, following Decree-Law No. 97/2026. The authorities interpret the mechanism as applying only where services are supplied by entities holding a valid contractor license (“alvará”) or certificate—a condition not expressly stated in the law. - Circular Letter No. 25116/2026 (23 June 2026) clarifies the reduced VAT rate (6% mainland, 4% Azores/Madeira) for construction and refurbishment of residential property, distinguishing between properties intended for the acquirer’s own permanent residence and those exclusively for residential rental, following the Decree-Law amendments. - The guidance details practical qualification conditions, including relevant value thresholds, documentation requirements, and compliance obligations for each type of qualifying housing project. Portugal Approves Amendment to VAT on Urban Rehabilitation — Clarification of Reduced Rate Conditions
- The Portuguese Parliament has approved, in general terms, an amendment clarifying the application of the reduced 6% VAT rate for urban rehabilitation works. The key change confirms that construction and rehabilitation projects located within officially designated Urban Rehabilitation Areas (ARUs) may benefit from the reduced rate even where no formally approved Urban Rehabilitation Operation (ORU) exists. This clarification is intended to resolve long-standing interpretative conflicts between taxpayers and the tax authorities regarding the legal prerequisites for applying the reduced VAT rate, particularly in the construction sector.
- The reform is framed as an “authentic interpretation” of Item 2.23 of List I of the Portuguese VAT Code, meaning it does not introduce a new rule but rather clarifies the meaning of existing legislation. Importantly, the measure is intended to apply retroactively to 2008, which could potentially affect past transactions where the standard VAT rate was applied and later disputed. This retroactive dimension raises significant fiscal and legal certainty considerations for developers and construction companies that have faced reassessments by the tax authorities.
- The amendment seeks to end years of litigation and administrative uncertainty, where tax authorities had increasingly required both ARU designation and ORU approval to justify the reduced VAT rate. By reaffirming that ARU status alone may be sufficient, the measure aims to restore consistency in VAT treatment and reduce disputes in the urban rehabilitation sector. However, the retroactive scope may also lead to reassessment claims and refund requests, creating potential fiscal exposure for both taxpayers and the state.
