Q1: If our gaming platform allows users to deposit using crypto currency, will the vat laws still apply?

  • A1: In most jurisdictions, crypto currency will be treated as the same as any financial instrument, however this will be very dependent on the jurisdiction.  India for example makes specific provision for the deposit of digital assets and expressly states that they must be taken into account when determining the amount deposited and the GST applicable.

Q2: What happens where a voucher is only partially redeemed?

  • A2: Single purpose vouchers are redeemable for a specific good or service, accordingly partial redemptions is rare. However, as redemption is not a separate taxable event, there will be no implications. With multipurpose vouchers the VAT will be calculated on the portion redeemed. Any balance later redeemed, will attract VAT when redeemed. In this instance there can be multiple taxable events in respect of the same multipurpose voucher.
