ECOFIN

Every so often, something in the VAT world shakes things up. A rate change here, a landmark ECJ judgment there, or maybe a shiny new rule to keep us on our toes. Last week, we had one of those moments: the ECOFIN meeting where all EU Member States agreed to the much-anticipated VAT in the Digital Age (ViDA) package. If you’ve been on our website lately, you’ve probably noticed we’re practically bursting with ViDA-related posts!

This is exciting news for the VAT community. After being teased back in December 2022, the ViDA package has finally come to fruition—just under two years after its initial announcement. Granted, it took a bit longer than the EU Commission expected, and the implementation will be slightly delayed, but hey, it’s official now!

So, what is this new package all about? In a nutshell, ViDA aims to tackle three main challenges:

The first is to close the VAT Gap. This gap—the difference between expected and actual VAT revenue—has been widening over the years, thanks in large part to VAT fraud. The Quick Fixes in 2020 helped (somewhat), and let’s be honest, COVID-19 played an unexpected role by grounding travel and freeing up resources for tax authorities to focus on compliance.

Secondly, the VAT rules needed adapting to the Digital Economy. With technological and economic shifts, especially in e-commerce, tax rules have struggled to keep pace. By making platform operators liable for VAT, tax authorities can now catch transactions that used to slip through the cracks.

And thirdly, the EU Commission explained that the rules aim to simplifying VAT for Businesses. This one’s a bit controversial. A single EU VAT registration with reduced admin sounds great on paper, but what’s the point if businesses can’t reclaim local input VAT through it? And while e-invoicing is touted as a way to cut down paperwork and errors, it also means businesses need to meet specific national e-invoicing standards—at least until 2035.

As with everything VAT, it’s a mixed bag. We could focus on the headaches of adjusting to new rules, or we can see this as a (small) step toward a more harmonized VAT system. And on the bright side, we’ll all have plenty of work for years to come—explaining, interpreting, and implementing these new rules. So, buckle up, keep those coffee cups full, and stay updated with us at VATupdate!
