Court of The Hague: Pro rata or actual use?

The defendant uses a lease contract from 2017 to determine the actual use of a combination building. Plaintiff argues that that agreement cannot be assumed because it does not reflect actual use. The court finds that plaintiff does not make this plausible. The court also rules that the pro rata calculation of the defendant is correct.
