On December 8, 2022, the European Court of Justice delivered a noteworthy judgment in the Luxury Trust Automobil case (C-247/21) on the invoice requirements when applying the ABC simplification in VAT. Because this judgment can have significant practical consequences, we will discuss the judgment of the Court of Justice and its impact on practice in more detail below.
In the Netherlands, the Tax and Customs Administration (for the time being) approves that the intermediary trader states ‘transfer simplified ABC scheme’ or ‘intra-Community delivery’ on the invoice. In any case, the latter variant does not seem to us to be compatible with the judgment of the Court of Justice.
