New Chinese food import legislation

Cooperation of the economy with FURS in the field of customs, excise and environmental duties

Legislation was passed this year in China to change the way food and beverages are imported into the Chinese market and to label products exported to China.

Two decrees were adopted.

248: Registration and management of food exporters

This Regulation defines the foods for which 2 different forms of registration are required for export to China. For “high risk” foods such as: meat and meat products, fish and other marine and freshwater products, dairy products, bird nests, bee products, eggs and egg products, edible oils and fats, oilseeds, stuffed pastries , edible cereals, milled products, fresh and dehydrated vegetables, dried beans, spices, nuts and seeds, dried fruits, unroasted coffee beans and cocoa beans, foods for particular nutritional uses and functional foods are different requirements than for “less risky foods.

Just about all food and beverage exports to China must be registered. Every exporting company must have a Chinese number after January 1, 2022, otherwise imports into China will not be possible. Registration must be done according to the category to which the food belongs. For this purpose, HS codes are published on the website of the General Customs Administration of the PRC (GACC), but they are changing, especially adding them.

It is especially important for the labeling of products and declarations on the outer and inner packaging and the customs declaration. This is the number obtained by the procedure under Regulation 248.
