New tax and customs amnesty regime introduced

A legislative decree (No. 173, “tax amnesty law”) published in El Salvador’s official gazette on 5 October 2021 introduces a new regime to encourage taxpayers to voluntarily comply with their tax and customs obligations. The tax amnesty law is now in force and the last day for taxpayers to apply for its benefits will be 10 December 2021.

The following are some relevant aspects of the tax amnesty law:

  • It grants a waiver of interest, surcharges, and fines for taxpayers that voluntarily comply with certain tax and customs obligations (e.g., payment of outstanding tax due). The benefits of the amnesty do not include a waiver of fines for noncompliance with formal obligations, such as late filing of tax returns;
  • The amnesty applies to obligations due on or before 30 June 2021; therefore, it applies to monthly tax returns related to May 2021 and prior months and annual tax returns for years up to fiscal year 2020;
