El Salvador Provides 60-day Tax Amnesty

El Salvador’s Ministry of Finance has announced that the Legislative Assembly has approved Decree No. 173 of 5 October 2021, which provides a tax amnesty to facilitate voluntary compliance with tax obligations that runs from 8 October to 10 December 2021. The amnesty provides an exemption from interest, surcharges, and fines for outstanding tax and customs obligations of natural and legal persons that expired up to 30 June 2021, which in the case of annual tax returns, includes taxes due up to the 2020 fiscal year. The amnesty also applies in the case of monthly returns, such as VAT and certain withholdings, which includes taxes due up to the May 2021 monthly period. In order to take advantage of the amnesty, taxpayers must pay the outstanding debt by 10 December 2021. However, an installment option is also provided for the amnesty benefit, including that debts may be paid in up to a maximum of seven monthly installments with at least 10% of the debt paid in the first installment.
