Advance Payments Are Now Taxable

  • Brazil’s new IBS/CBS/IS tax system shifts the taxable event for certain transactions from delivery to the receipt of advance payments, requiring businesses to immediately issue a debit NF-e type 06, report the tax in the payment period, and later deduct it upon final delivery to avoid double taxation.
  • To prevent double taxation, the final invoice must reference these advance payments using the <gPagAntecipado> group, which automatically offsets the tax already paid, necessitating that ERP systems track, link, and reverse advance payment taxation.
  • This advance taxation applies to various scenarios like down payments, installment payments before delivery, full upfront payments, and advanced service payments, with a mandatory debit NF-e type 06 for each amount received, and provisions for tax adjustments in case of contract cancellation.
