- Spain has approved mandatory B2B e-invoicing under the “Ley Crea y Crece,” which will require businesses to issue, send, and receive electronic invoices for all B2B transactions; however, the final implementation dates are still pending confirmation, with expectations for the requirement to take effect progressively starting from July 2024.
- The e-invoicing mandate will initially apply to large taxpayers with annual turnovers exceeding 8 million Euros, one year after the approval of the implementing regulation, followed by the remaining taxpayers two years later, although details on compliance for non-established businesses registered for VAT in Spain remain unclear.
- Key requirements for the e-invoices include compliance with the European e-invoicing standard, the use of specific formats (XML, UBL, EDIFACT, and Facturae), the necessity for invoicing software to meet security standards, and obligations for recipients to report the status of received invoices, ensuring interoperability between private and public platforms.
