The Romanian Government has adopted Emergency Ordinance no. 115/2023, which introduces new regulations for e-Invoicing in B2B transactions within the country. The ordinance specifies deadlines for e-invoice reporting, a grace period until June 30, 2024 for non-compliance, and outlines transactions that are out of scope for e-invoicing and e-reporting. Penalties for non-compliance with e-invoicing requirements will be applicable from July 1, 2024, with a 15% penalty of the invoice value for both parties. Additionally, there are additional penalties for neglecting the responsibility to move forward with e-reporting. The penalties vary based on the taxpayer’s classification.
