“In areas declared as a disaster-stricken region with significant effects on public life due to earthquakes occurring on 6/2/2023, the delivery and services to be provided to public institutions and organizations, which will be donated to disaster victims within the scope of the protocol signed with the Disaster and Emergency Management Authority (AFAD), regarding the construction of housing to be donated to disaster victims, are exempt from value added tax until 31/12/2024.
In this context, the VAT burdened by these deliveries and services is deducted from the VAT calculated on taxable transactions. VAT that cannot be offset by deduction is refunded upon the request of the taxpayer performing transactions within the scope of exemption, in accordance with the provisions of Article 32 of this Law.
The extension of the period specified in the first paragraph up to one year is authorized by the President; determining the deliveries and services to be covered by the exemption, and determining the procedures and principles regarding the exemption and refund is authorized by the Ministry of Treasury and Finance.”
