A ruling was recently published on the question whether employees of a foreign employer who work from home in the Netherlands form a permanent establishment in the Netherlands. This is an important question, because the presence of a permanent establishment will lead to corporate income tax obligations, but also to a withholding obligation for Dutch payroll taxes.
