The former president of the management board did not want to be held responsible for the company’s tax obligations. For this purpose, he tried to prove that the company had only one creditor, so filing for bankruptcy was not justified. The Supreme Administrative Court emphasized that adopting such a view would lead to unequal treatment of management board members depending on how many creditors the companies managed by them had.
