Who should be considered a person liable to pay VAT in a situation where a taxpayer’s employee issued a false invoice with the indicated VAT, on which he showed the employer’s data as a taxpayer, without his knowledge and consent? This question is addressed by the Supreme Administrative Court to the Court of Justice of the European Union. The tax authority and the Provincial Administrative Court pointed to the company’s responsibility.
