Under article 46(12) of the VAT Act 2000 (95(I)/2000), where a Criminal Court finds that a person is guilty of failing to pay to the commissioner any sum of money, which he is liable to pay under the provisions of the act, it may, in addition to imposing a penalty, issue an order against the convicted person to pay to the commissioner such sum.
