Texas – New Law Modifies Definition of Video Service and Excludes Streaming Content

  • Modification of Video Service Definition: Texas Senate Bill 924, effective September 1, 2025, modifies the definition of “video service” under the Texas Public Utility Regulatory Act (PURA) to exclude certain services from local cable franchise fees.
  • Exclusions for Satellite and Streaming Services: The new law specifically excludes direct-to-home satellite services that transmit directly to customers without utilizing public right-of-way, as well as any video programming accessed through internet-based services, including streaming content.
  • Response to Local Fee Attempts: This legislation was enacted in response to municipalities trying to impose cable franchise fees on satellite and streaming providers, ensuring these services are not subjected to the same regulations as traditional cable services.
