Poland Introduces KSeF 2.0 Draft Legislation with Key E-Invoicing Updates for 2026 Rollout

  • New Draft Legislation for KSeF 2.0: Poland’s Ministry of Finance has introduced draft legislation for KSeF 2.0, set to roll out mandatory e-invoicing by February or April 2026, featuring updates such as Offline24 invoicing, stricter rules for corrective invoices, and expanded eligibility for receiving invoices outside of KSeF.
  • Operational and Authentication Changes: The new framework mandates that third-party payers use KSeF IDs for bank payments and transitions to certificate-based authentication by the end of 2026. Additionally, structured attachments will be allowed with prior notification to the e-Tax Office.
  • Provisions for Exemptions and Participation: The legislation includes extended exemptions for digitally excluded taxpayers, allowing for a per-invoice exemption until the end of 2026, and permits voluntary participation in KSeF for foreign buyers using EU VAT IDs in cross-border self-billing transactions.
