In a lawsuit brought forth under Illinois’ False Claims Act against various retailers, an Illinois Appellate Court agreed that based on Illinois Department of Revenue guidance from 2015, the appliance retailers at issue owed Illinois sales tax on appliances they sold to Illinois customers – even when the customers also paid them for installing the same appliances – and they did not function as construction contractors.
