- On 3 July 2024, the Canadian government announced that the Digital Services Tax Act (DSTA) would come into force on 28 June 2024, following an Order in Council issued by the Governor General in Council based on the Minister of Finance’s recommendation.
- This surprised many in the industry as it came shortly after the implementation of certain measures from the 2023 fall economic statement and the 2023 federal budget, including the DSTA.
- Despite speculation about a later coming-into-force date, the OIC was issued in consideration of the OECD’s Two-Pillar Solution and Canada’s preference for a multilateral approach to addressing digital economy challenges.
- As a result, taxpayers need to consider the potential impact of the DSTA now that it is in force.
