The Arnhem-Leeuwarden Court of Appeal ruled that X BV, Y BV, and Z BV do not form a VAT group due to lack of financial interdependence. Shareholders B and C have ownership in X BV and Y BV, but there is no evidence of voting agreements between the companies. The appeal by X BV was unsuccessful.
