- The Amendment Act for the Environmental Management Act will be effective on December 6, 2023, in connection with the transition period for the implementation of the Carbon Border Adjustment Mechanism (CBAM).
- This Act includes changes such as the inclusion of the concept and definition of “Regulation on carbon correction at the border” in the Environmental Management Act and the addition of the implementation of this regulation to the powers of the Dutch Emissions Authority (NEa).
- A new reporting obligation for CBAM goods importers is also introduced in Chapter 16C, with the NEa having the authority to impose penalties for non-compliance.
- The Netherlands fulfills its obligation to designate a national CBAM authority for the transition period with the Carbon Border Adjustment Regulation taking effect on October 1, 2023.
