To promote investment tokens, the Thai Revenue Department issued the Royal Decree in August 2023concerning an exemption related to the improvement of taxation for investment tokens. In summary, both thecorporate income tax and value added tax (VAT) exemptions are available for the offering of investmenttokens in the primary market whereas the transfer of investment tokens in the secondary market will also beexempt from VAT. The rationale behind this is that investment tokens, similar to securities, may becategorized as equity or debt, and consequently, the tax obligations for the offering and sale of investmenttokens, both in the primary and secondary markets, should be similar to those applicable to securities.
