In February 2023, the Supreme Court ruled that the VAT zero rate did not apply to digital editions of newspapers. HMRC have now published RCB 6 (2023), which states that HMRC will be writing to taxpayers that had submitted VAT claims based on the earlier Upper Tribunal decision to confirm whether they intend to proceed with their appeals, given the Supreme Court judgment.
