The judgment of the Court of Justice of the European Union, issued on June 8, 2023, stating that Polish provisions on interest rates on overpayments are incompatible with EU law, is another breakthrough in the approach to the treatment of foreign funds from third countries (i.e. outside the EU / EEA) investing in Poland. However, its practical significance may be broader.
