The question of whether it falls within the discretion of the Netherlands as a member state to distinguish between service providers trained at intermediate vocational and higher vocational education level does not require discussion. The Supreme Court has rejected the appeal in cassation of the State Secretary against this decision, referring to Section 81 of the RO Act.
