The analysis of financial services transactions with a view to determining the correct VAT treatment, particularly regarding the application of the exemptions set out in the VAT Directive has always been a challenging task. To complicate matters, the EU VAT rules for financial services have remained unchanged notwithstanding the exponential growth of new financial services products on the market and the parallel evolution of technology that facilitates their uptake.
In this seminar, we will be reviewing the financial services exemptions contained in the VAT Directive as well as outlining the interpretation of certain concepts linked to financial services emanating from the settled case law of the European Court of Justice. Finally, we will outline the consequential VAT implications and round up the session with some practical scenarios.
