On its website, the BAFA points to the public consultation of the EU Commission towards the “”Guidelines”” of cyber monitoring. The EU Dual-Use Regulation (EU) 2021/821 tightens export controls on digital surveillance items not listed in Annex I that may be used, in whole or in part, for internal repression and/or the commission of serious violations of human rights and international humanitarian law. The Regulation mandates the European Commission to provide guidance to exporters on Article 5 in accordance with Article 26.
