On the basis of which criteria should it be assessed whether an essentially new building has arisen as a result of renovation work on an existing building? This was the subject of preliminary questions that the Zeeland-West Brabant District Court put to the Supreme Court. If such an essentially new building has been created, turnover tax is due on its delivery and the acquisition is exempt from transfer tax.
