State Secretary Van Rij of Finance has explained to the Senate why he has chosen to lower the VAT on the supply of electricity and gas by policy decision before this is regulated by law.
On 21 June 2022, the House of Representatives passed the bill for the 2022 Additional Fiscal Purchasing Power Measures Act (36088). This bill provides for retroactive effect to 1 July 2022 in order for the VAT measure to be in force in the period envisaged by the cabinet from 1 July 2022 to 31 December 2022. It is important for energy suppliers to have legal certainty with regard to the VAT rate that applies to the supplies of electricity and gas that they make on and after 1 July.
