The Court of Justice of the European Union issued a judgment on March 31, 2022, in which it dismissed the complaint of the European Commission against Poland regarding the exemption from excise duty on energy products used by energy-intensive plants. The CJEU stated that EU regulations do not exclude from the exemption from excise duty energy-intensive companies covered by the EU emissions trading system.
