Russia has published Federal Law No. 97-FZ of 16 April 2022, which amends Article 149 (VAT Exempt Transactions) of Part Two of the Russia Tax Code to provide for the introduction of a VAT exemption on the sale and transfer of exclusive rights for certain intellectual property. The VAT exemption covers exclusive rights to inventions, utility models, industrial designs, integrated circuit topographies, and trade secrets (know-how), as well as rights to use the results of such intellectual property under a franchise agreement. The law enters into force one month after publication, but not earlier than the first day of the next VAT period, i.e., the exemption will apply from 1 July 2022.
