A judgment was recently published in which the private use of holiday homes to be determined was central. In the relevant years there were days when the holiday home was not used (vacancy). The Supreme Court has ruled that the days of vacancy cannot be counted as private use in the situation in question. This seems to deviate for certain situations from the previous case law in which the deduction was determined on the basis of actual/actual use.
