X objected and requested a refund of € 5.3 million VAT for the unused MBs and on donations within the data bundles.
The Gelderland District Court ruled against BV X. If the customer did not use all units of use (call minutes, SMS, MBs) within a bundle of the subscription, BV X did not refund part of the subscription price to the customer (ECJ Vodafone Portugal).
