On 12 May 2021, amendments to the Digital Advertising Tax in the U.S. State of Maryland entered into force due to inaction by the Governor (did not sign or veto). As previously reported, Senate Bill (SB) 787 was approved on 12 April 2021, including the following amendments:
- Exempting from the tax advertisement services on certain digital interfaces owned or operated by or operated on behalf of a broadcast entity and news media entity;
- Prohibiting a person who derives gross revenues from digital advertising in the State from passing on the cost of the tax to customers; and
- Delaying the application of the tax to taxable years beginning after 31 December 2021 (previously applied to taxable years beginning after 31 December 2020).
