The Supreme Court recently confirmed an opinion of an Arnhem-Leeuwarden Court that this special arrangement is not applicable if a project developer rents a property for sale. For the special scheme to apply, it is required that the project developer himself has the aim of operating the property in a sustainable manner. This is not the case in this situation, because this project developer intends to sell the property.
