On April 25, 2019, the French government issued Ordinance N° 2019-359, in order to amend the French Code of Commerce. The focus of the text is legal and not tax.
The aim of the measures in this Ordinance is to establish better compliance of parties with payment deadlines to their suppliers. In that respect the legal invoice requirements are amended as follows:
- 1. in case the address for invoicing differs from the regular address of either seller or customer, both addresses should be indicated on the invoice.
- 2. In case a purchase order number has been designated by the customer, this must be indicated on the invoices as well.
Penalties for non-compliance with these invoicing requirements are severe (€375,000 for legal entities, which in case of repeated offenses will be doubled to €750,000)
The new invoicing rules shall only apply to invoices issued as of 1st October 2019.
