There have recently been two important developments concerning VAT in respect of pension funds and (real estate) investment funds. This relates to the Opinion issued by the Advocate General (AG) in the PPG Holding case and the hearing at the Court of Justice of the European Union in the VAT group X case.
Opinion in the PPG Holding BV case
In the PPG Holding BV (PPG) case, the AG at the Supreme Court, Ms. M.E. van Hilten, recently concluded that PPG could deduct the VAT charged on expenses incurred for its own pension fund. Click here for the full report about this Opinion on our website.
Hearing in the VAT group X case
On March 4, 2015, the hearing in the VAT group X case was held at the Court of Justice of the European Union. This case concerns the VAT treatment of the management of real estate funds, but is also relevant for other investment funds. It is, for example, interesting that the European Commission considers that the exemption for the management of special investment funds must be broadly interpreted.
