8% VAT Applies to Typical Box-Diet Packages

Summary

  • A typical box-diet arrangement comprising the preparation of a full-day meal plan, packaging, menu or calorie selection, and recurring home delivery should generally be classified under PKWiU Division 56 and taxed at 8%, rather than the 5% rate applicable to certain food products. [prawo.pl]
  • The conclusion applies even though the transaction may constitute a supply of goods for VAT purposes. Polish legislation extends the 8% treatment to both goods and services classified under PKWiU 56, subject to specific statutory exclusions. [prawo.pl]
  • Businesses applying 5% should review their classification and pricing following the judgment of the Supreme Administrative Court of 12 June 2026, case I FSK 1561/25, and the binding rate information issued on 10 August 2026. [prawo.pl]

Article

Polish box-diet providers face an increased risk of VAT assessments where they apply the 5% rate to comprehensive daily meal packages. In a judgment dated 12 June 2026, case I FSK 1561/25, the Supreme Administrative Court accepted that the delivery of prepared meals could constitute a supply of goods rather than a conventional restaurant service. However, this did not prevent the transaction from being classified under PKWiU Division 56, covering food-service activities, and therefore attracting the 8% VAT rate. [prawo.pl]
The relevant business model involved customers choosing a diet type, calorie level, menu, and delivery period. The supplier prepared a complete set of meals for the day, portioned and packaged them, and delivered them to the customer. The court considered that customers were not simply purchasing a random collection of food products. The commercial offer included the design and preparation of a coordinated daily meal programme tailored to the selected dietary parameters. [prawo.pl]
This distinction is important because Article 41(12f) of the Polish VAT Act applies the reduced 8% rate to supplies classified under PKWiU 56, including relevant supplies of goods. Accordingly, characterising the transaction as a supply of goods does not, by itself, establish entitlement to the 5% food rate. [prawo.pl]
The judgment has already been reflected in binding rate information issued by the Director of National Tax Information on 10 August 2026, reference 0111-KDSB1-1.440.117.2026.7.JJ. That decision concerned a five-meal daily package delivered to the customer and classified the composite supply under PKWiU 56 at 8%. Earlier binding rate decisions from 2023 and 2024 had reached comparable conclusions. [prawo.pl]
Providers should review product classifications, binding rate information, invoicing logic, customer contracts, and the treatment of delivery charges. Particular attention should be given to beverages and other statutory exclusions, since the precise contents of a package can affect the analysis. Businesses currently applying 5% should also assess historical exposure and consider whether obtaining their own binding rate information would provide appropriate protection.
