1. What is the general legislative framework regulating packaging and plastic waste in your jurisdiction?
The Mexican Constitution establishes the right to a healthy environment, the State’s duty to guarantee that right, and the liability of those who cause environmental damage. Environmental matters are subject to federal, local and municipal laws. However, the faculties of each level of government are distributed by the Federal Congress through general laws.
The General Law on the Prevention and Comprehensive Management of Waste (Ley General para la Prevención y Gestion Integral de los Residuos, “LGPGIR”) establishes the “polluter payer” principle and “from cradle to grave principles”, sets forth the regulations governing waste management, and distributes faculties among the different levels of government.
