CBP and FLETF issue guidance for importers under ‘Uyghur Forced Labor Prevention Act’

US Customs and Border Protection (CBP) on June 13 released a 17-page operational guidance for importers regarding P.L. 117-78, commonly referred to as the ‘Uyghur Forced Labor Prevention Act’ (UFLPA), which was signed into law by President Biden on December 23, 2021.

The UFLPA establishes a rebuttable presumption that the importation of any goods, wares, articles, or merchandise mined, produced, or manufactured wholly or in part in the Xinjiang Uyghur Autonomous Region (XUAR) of the People’s Republic of China, or produced by certain entities on the Forced Labor Enforcement Task Force (FLETF) Entity List, is prohibited by Section 307 of the Tariff Act of 1930 and that such goods, wares, articles, or merchandise are not entitled to entry into the United States.
