Peru Regulates Input Tax Credit for Sale of Basic Foodstuffs Covered by Temporary VAT Exemption

Peru has published Supreme Decree No. 083-2022-EF, which regulates the input tax credit for the sale of basic foodstuffs temporarily exempted from VAT by Law No. 31452. As previously reported, the VAT exemption is provided to mitigate the impact of inflation with effect from 1 May 2022 until 31 July 2022. The law also provides that taxpayers selling foodstuffs covered by the exemption are allowed to claim input tax credits corresponding to the acquisition and/or import of the main inputs required in the production of the exempted foodstuffs. For this purpose, Supreme Decree No. 083-2022-EF establishes the list of products eligible for input tax credit claims when used as inputs in the production of exempted foodstuffs.
