The Amsterdam Court of Appeal rules that X bv cannot apply the VAT exemption for investment institutions. X bv does not compete with UCITS institutions and has more the characteristics of a promotional fund than an investment fund. The Supreme Court declares the appeal in cassation without further motivation unfounded (art. 81 paragraph 1 RO Act).
