CAT Ordinance No. 07/2020 was published in the Official Gazette this Saturday (1st), further facilitating the activities of companies that sell in the market place .
The rule changed Ordinance No. 31, of 06/18/2019, which brought more favorable conditions to those who sell via the Internet , allowing companies of any size and from all over the country to count on the expertise of logistics companies installed in São Paulo. to promote your sales – anywhere in the national territory – with your customers.
Now, the main change made through the was the permission given to Simples Nacional companies, located in other States, to promote the sending of their goods to the warehouse of a São Paulo logistics operator and to negotiate with final consumers in this or another State, without the need to register in the ICMS Taxpayer Register of the State of São Paulo. To this end, it is required that, in addition to the company belonging to Simples Nacional, sales should be made to individual consumers.
In order to improve control over these activities, the new ordinance also establishes the need for accreditation for Logistics Operators who wish to apply this system. There is also a provision for disqualification if the Logistics Operator fails to meet the requirements contained in the ordinance.
The amendments reaffirm the commitment of the State Government to promote concrete initiatives to promote the economy, simplify tax legislation and improve the business environment for new investments in São Paulo, without giving up its responsibility to avoid unfair competition and fraud.
